Terms of Service

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Cascade Manufacturing website or any other services provided by Cascade Manufacturing ("us", "we", or "our"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access or use our services.
- General Provisions
1.1. Cascade Manufacturing is an online platform that allows users to design, customize, and order staircases for personal or commercial use.
1.2. By using our services, you represent and warrant that you are at least 18 years old and possess the legal authority to enter into these Terms.
1.3. We reserve the right to modify or discontinue our services at any time, without prior notice. We may also update these Terms from time to time. Your continued use of our services after any such changes constitutes your acceptance of the new Terms.
- User Accounts
2.1. To access some features of our services, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account and password, as well as for any activity that occurs under your account.
2.2. You agree to provide accurate and complete information when creating an account and to keep this information up to date. We reserve the right to suspend or terminate your account if we suspect any unauthorized use or if any information provided is found to be false or misleading.
- Design and Ordering Process
3.1. By using our platform, you can create and customize your own staircase designs, using the tools and materials provided.
3.2. You are responsible for ensuring that your design complies with all applicable laws, regulations, and building codes in your jurisdiction.
3.3. Once your design is complete, you may submit your order to us. We reserve the right to reject any order at our sole discretion.
3.4. Upon acceptance of your order, we will provide you with an estimated delivery date. While we strive to meet these delivery dates, they are not guaranteed and are subject to change.
- Pricing and Payment
4.1. The price of your staircase will be calculated based on your design choices, materials, and any additional services requested. All prices are subject to change without notice.
4.2. Full payment is required at the time of placing your order. We accept various payment methods, which will be specified at the time of checkout.
4.3. You are responsible for any taxes, duties, or other charges that may apply to your order.
- Cancellations and Refunds
5.1. Due to the custom nature of our products, all sales are final. Cancellations or changes to your order are only permitted within 48 hours of placing your order, and must be requested in writing by contacting our customer service team at firstname.lastname@example.org. Cancellation or change requests submitted after the 48-hour window will not be honored and the full payment for the order will be non-refundable.
5.2. In the event of a cancellation within the 48-hour window, the customer will be eligible for a full refund, less any applicable payment processing fees. Refunds will be processed within 14 business days and will be credited to the original payment method.
5.3. If the customer identifies any defects or inaccuracies in the completed custom staircase, they must notify our customer service team in writing within 7 days of receipt of the product. We will work closely with the customer to rectify the issue and, at our sole discretion, either repair or replace the defective or inaccurate part(s) at no additional cost to the customer.
5.4. If a repair or replacement is not feasible or would cause undue hardship to the customer, we reserve the right to issue a partial or full refund for the affected product. The amount of the refund will be determined at our sole discretion, based on the extent of the defect or inaccuracy.
5.5. In the event of a dispute regarding a refund, the customer agrees to first attempt to resolve the dispute by contacting our customer service team. If the dispute cannot be resolved through direct communication, the customer may seek legal remedies as permitted by law.
5.6. We are not responsible for any costs or damages incurred by the customer as a result of delays in production or delivery, including but not limited to labor costs, storage fees, or additional shipping costs. We will make every effort to communicate any potential delays and work with the customer to minimize any inconvenience.
5.7. We reserve the right to cancel any order at our sole discretion. In such cases, the customer will be notified in writing and will receive a full refund for the canceled order within 14 business days.
By placing an order with Cascade Manufacturing, the customer acknowledges and agrees to the Cancellations and Refunds policy outlined in this section.
- Limitation of Liability
6.1. To the maximum extent permitted by applicable law, in no event shall Cascade Manufacturing, its affiliates, directors, officers, employees, agents, or suppliers be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, loss of data, loss of use, or other economic advantage, arising out of or in connection with the use of our products, services, or these Terms of Service, even if Cascade Manufacturing has been advised of the possibility of such damages.
6.2. Cascade Manufacturing's total cumulative liability in connection with these Terms of Service, the use of our products, or any services provided, shall not exceed the amount paid by the customer to Cascade Manufacturing for the specific product or service giving rise to the liability.
6.3. The customer agrees to indemnify, defend, and hold harmless [Cascade Manufacturing, its affiliates, directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorney's fees and costs, arising out of or in any way connected with the customer's access to or use of our products or services.
6.4. Cascade Manufacturing shall not be held responsible for any injury, death, or property damage resulting from the installation, use, or maintenance of our products, whether performed by the customer, a third-party contractor, or any other person. The customer assumes all risks associated with the installation, use, and maintenance of our products.
6.5. Any claims arising out of or relating to these Terms of Service or our products and services shall be brought within one (1) year from the date on which the cause of action arose. Claims not brought within this time period shall be deemed waived and forever barred.
By placing an order with Cascade Manufacturing, the customer acknowledges and agrees to the Limitation of Liability policy outlined in this section.
